TERMS OF USE
Last updated: 12 September 2026
These Terms of Use govern access to and use of www.backtrip.eu and any related webpages, features, booking interfaces, forms, content, and services made available through the website (collectively, the “Website”).
The Website is operated by BackTrip & Travel (“BackTrip”, “we”, “us”, or “our”), a travel and tourism company established in France.
By accessing, browsing, or using this Website, you acknowledge that you have read, understood, and agree to comply with these Terms of Use.
If you do not agree with these Terms, please do not use the Website.
Specific purchases, reservations, tours, transfers, travel packages, or other travel services may also be governed by our Terms and Conditions of Sale / Booking Terms (“CGV”), the specific conditions displayed for the selected service, and your booking confirmation. In the event of a conflict concerning a booking, the applicable Booking Terms and specific booking conditions shall prevail over these general Website Terms of Use.
1. Purpose of the Website
The Website is intended to provide information about BackTrip & Travel and the travel experiences and related services that we offer or arrange.
Through the Website, users may, depending on the services available:
browse tours, excursions, transfers, packages, private experiences, and other travel services;
review itineraries, descriptions, photographs, availability, and indicative pricing;
submit booking requests or make reservations;
make or initiate payments;
contact our Customer Support and Reservations teams;
request quotations for private or customised travel services;
subscribe to communications where available;
access information relating to existing bookings; and
obtain information about BackTrip & Travel and our destinations.
The Website may be updated, expanded, modified, or temporarily unavailable from time to time.
2. Acceptance of These Terms
By using the Website, you confirm that you have the legal capacity to use the Website and, when making a reservation, to enter into a binding agreement.
When you make a reservation on behalf of other travellers, you confirm that you are authorised to provide the necessary information on their behalf and to communicate the applicable booking conditions to them.
The person making the booking is responsible for ensuring that all information supplied in connection with the reservation is complete and accurate.
3. Permitted Use of the Website
You may use the Website for lawful personal or professional travel-related purposes, including researching, comparing, requesting, or purchasing travel services.
You agree not to:
use the Website for any unlawful, fraudulent, misleading, or abusive purpose;
attempt to gain unauthorised access to the Website, its servers, databases, booking systems, accounts, or security features;
introduce viruses, malware, malicious code, or other material capable of damaging the Website or another user's device;
interfere with the normal operation, security, or availability of the Website;
impersonate another person or provide false or misleading information;
attempt to circumvent security, payment, availability, pricing, or booking controls;
reproduce, copy, republish, resell, distribute, or commercially exploit Website content without our written permission;
systematically scrape, harvest, extract, index, download, or collect Website data using automated tools, bots, spiders, scripts, or similar technologies, except where expressly authorised by BackTrip or where necessary for legitimate search-engine indexing;
use Website content, photographs, itineraries, descriptions, databases, or other proprietary materials to create competing products or services without authorisation; or
use Website content for automated commercial data extraction or artificial-intelligence model training without our prior written authorisation.
We reserve the right to restrict or block access to the Website where we reasonably believe these Terms have been violated.
4. Travel Information and Website Content
We make reasonable efforts to ensure that information displayed on the Website is accurate and up to date.
However, tourism services are subject to operational circumstances and information concerning destinations, attractions, opening times, transportation, itineraries, suppliers, wineries, museums, restaurants, hotels, monuments, weather conditions, and other third-party services may change.
Photographs, maps, illustrations, videos, suggested itineraries, vehicle images, tasting examples, and destination descriptions are provided to help users understand the general nature of an experience. Unless expressly stated otherwise, they should not be interpreted as a contractual guarantee that every element shown will be provided in exactly the same manner.
Any material modification affecting a confirmed booking will be handled in accordance with the applicable booking conditions and mandatory law.
5. Tours, Itineraries and Travel Experiences
BackTrip & Travel offers various travel experiences, which may include guided tours, private excursions, small-group tours, transportation, entrance tickets, tastings, accommodation, restaurant reservations, workshops, and other travel-related services.
The exact inclusions and exclusions applicable to a service are those stated on the relevant product page and/or booking confirmation.
Certain elements of an itinerary may depend on circumstances outside our direct control, including:
opening hours;
supplier availability;
seasonal closures;
road conditions;
traffic;
weather;
strikes;
public events;
security restrictions;
monument or museum closures;
harvest periods;
winery or Champagne House operations; and
other operational circumstances.
Where reasonably necessary, an itinerary, timing, route, supplier, tasting location, visiting order, vehicle, or similar operational element may be adjusted while seeking to preserve the overall character and quality of the booked experience.
Any rights arising from a significant modification are governed by the applicable Booking Terms and mandatory consumer law.
6. Bookings and Confirmation
Displaying a tour or service on the Website does not by itself guarantee availability.
A booking becomes confirmed only once the reservation process required for the particular service has been completed and confirmation has been issued by BackTrip & Travel or by the authorised booking platform through which the reservation was made.
We may request additional information where reasonably necessary to process a booking, including:
traveller names;
number of participants;
ages of children where relevant;
preferred language;
accommodation or pick-up information;
accessibility or mobility requirements;
contact details; and
other information necessary to operate the requested service.
You are responsible for checking your booking confirmation promptly and notifying us of any errors as soon as possible.
7. Prices
Prices displayed on the Website are shown in the currency indicated on the relevant page, normally euros (€), unless otherwise specified.
Prices may vary according to factors including:
travel date;
number of participants;
private or shared service;
vehicle category;
selected experiences or upgrades;
availability;
entrance fees;
accommodation;
supplier pricing; and
other components of the requested service.
Until a booking is confirmed, prices and availability may change.
Once a booking is confirmed, any subsequent change requested by the customer may result in a change to the price.
Any applicable taxes, fees, supplements, commissions, or optional extras will be indicated during the booking process or in the quotation/confirmation where required.
In the event of an obvious technical or pricing error, we reserve the right to correct the error before confirming the reservation. If an error is discovered after a reservation has been made, we will contact the customer and handle the situation in accordance with applicable law.
8. Payments
Depending on the selected service, payments may be processed directly through the Website or through a secure third-party payment provider.
BackTrip & Travel does not necessarily store full payment-card details when transactions are processed by an authorised payment service provider.
Payment methods, deposits, payment deadlines, currency conversion, and any applicable payment conditions will be communicated during the booking process or in the relevant quotation or booking confirmation.
A booking may be cancelled or considered unconfirmed where required payment has not been received within the applicable deadline, subject to the specific Booking Terms.
9. Cancellations, Amendments and Refunds
Cancellation and amendment conditions vary according to the tour, travel service, rate, supplier, booking channel, and type of reservation.
The cancellation policy applicable to your reservation will be the policy communicated on the product page, during the booking process, in our applicable Booking Terms, and/or in your booking confirmation.
Refund eligibility will therefore depend on the conditions applicable to the individual reservation.
Where a reservation was made through a third-party booking platform such as an online travel agency, requests for changes, cancellations, or refunds may also be subject to that platform's procedures and contractual conditions.
Nothing in these Terms limits any mandatory statutory rights available to consumers under applicable law.
10. Bookings Through Third-Party Platforms
BackTrip & Travel products may also be offered through authorised travel agencies, resellers, online travel agencies, marketplaces, hotel concierges, or other distribution partners.
Where a reservation is made through a third-party platform, additional terms imposed by that platform may apply.
Payment, cancellation, modification, refund, and customer-service procedures may differ depending on the booking channel.
Users should therefore review the conditions applicable to the platform through which the reservation was made.
BackTrip is not responsible for the independent operation of third-party websites or booking platforms, but this does not affect any responsibility that BackTrip may have for travel services that it is legally required to provide.
11. Third-Party Travel Suppliers
Certain components of our travel experiences may be provided by independent third parties, such as:
hotels;
wineries and Champagne Houses;
restaurants;
museums;
monuments;
attractions;
activity providers;
transportation companies;
ferry or rail operators;
ticketing providers;
local guides; and
other tourism suppliers.
The participation of third-party suppliers does not automatically make BackTrip responsible for every action or omission of those suppliers.
However, nothing in these Terms excludes or reduces any responsibility imposed on BackTrip by applicable French or European travel and consumer legislation.
12. Customer Responsibilities
Customers are responsible for providing accurate information and for arriving at the confirmed meeting point or being available at the confirmed pick-up location at the communicated time.
Travellers are also responsible, where applicable, for ensuring that they possess any required:
passport;
visa;
identity document;
travel authorisation;
insurance;
health documentation; or
other documentation necessary for their journey.
For international excursions, including journeys between France and neighbouring countries, passengers should carry appropriate identification and travel documentation.
Customers should inform us before the tour of any relevant accessibility or mobility requirements that may affect participation so that we can determine whether reasonable arrangements can be made.
13. Intellectual Property
Unless otherwise indicated, the Website and its contents are owned by, licensed to, or lawfully used by BackTrip & Travel.
This includes, without limitation:
the BackTrip name and brand;
logos;
tour names;
Website design;
photographs;
videos;
graphics;
illustrations;
texts;
tour descriptions;
destination content;
itineraries;
databases;
downloadable documents; and
other original material.
These materials may be protected by copyright, trademark, database rights, and other intellectual-property laws.
You may view Website content for your own legitimate travel-planning purposes.
You may not reproduce, republish, distribute, sell, license, commercially exploit, systematically extract, modify, or create derivative commercial materials from Website content without prior written permission from BackTrip & Travel or the relevant rights holder.
Third-party names, brands, logos, and trademarks appearing on the Website remain the property of their respective owners.
14. Photographs, Reviews and User-Submitted Content
Where the Website allows customers to submit reviews, comments, photographs, testimonials, or other content, users remain responsible for the material they submit.
Users must not submit content that:
infringes another person's intellectual-property rights;
violates another person's privacy;
contains unlawful, discriminatory, defamatory, threatening, or offensive material;
is fraudulent or misleading;
contains malicious software; or
constitutes unauthorised commercial advertising.
Where BackTrip wishes to use identifiable customer photographs or videos for promotional or marketing purposes, such use will be handled in accordance with applicable privacy and image-right requirements and any consent obtained from the individuals concerned.
15. Privacy and Personal Data
BackTrip & Travel respects the privacy of Website users and customers.
Personal information may be collected when you:
make or request a booking;
request a quotation;
complete a Website form;
contact Customer Support;
subscribe to communications;
make a payment;
participate in a tour; or
otherwise interact with our services.
The processing of personal data is governed by our Privacy Policy, which explains how personal information is collected, used, stored, shared, and protected and describes the rights available to individuals under applicable data-protection legislation.
Please consult our Privacy Policy for further information.
16. Cookies and Similar Technologies
The Website may use cookies and similar technologies for purposes including:
essential Website functionality;
security;
booking functionality;
remembering preferences;
audience measurement;
analytics;
advertising or marketing; and
improving Website performance.
Where consent is legally required, relevant non-essential cookies will be used only in accordance with the choices made through our cookie-management system.
Users can review or modify their cookie preferences through the Website's cookie settings where available.
Further information is provided in our Cookie Policy.
17. Links to External Websites
The Website may contain links to websites, applications, payment services, booking platforms, social networks, maps, tourism organisations, suppliers, or other third-party resources.
These links are provided for convenience or informational purposes.
BackTrip does not control the content, security, availability, privacy practices, or independent services of third-party websites.
Accessing a third-party website is therefore subject to that provider's own terms and policies.
The presence of a link does not necessarily constitute an endorsement of all content or services available on the external website.
18. Website Availability and Security
We aim to keep the Website available and functioning correctly but cannot guarantee uninterrupted or error-free access at all times.
Access may occasionally be interrupted because of:
maintenance;
system updates;
hosting issues;
security measures;
telecommunications failures;
third-party service failures; or
circumstances outside our reasonable control.
We may modify, suspend, restrict, or discontinue Website functionality where reasonably necessary.
Users are responsible for maintaining appropriate security on their own devices and internet connections.
19. Limitation of Liability
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, or any mandatory rights granted to consumers under applicable law.
Subject to those rights, BackTrip & Travel cannot be held responsible for losses resulting solely from:
improper or unlawful use of the Website;
inaccurate information supplied by the user;
the user's failure to follow booking instructions;
unauthorised access resulting from the user's failure to protect their own credentials or device;
independent third-party websites that are not controlled by BackTrip; or
circumstances for which BackTrip is not legally responsible.
Information provided on general destination pages, blogs, guides, articles, or similar editorial sections of the Website is provided for general informational purposes and should not replace official governmental, legal, immigration, health, or safety advice.
20. Force Majeure and Extraordinary Circumstances
Travel services may occasionally be affected by events beyond the reasonable control of the parties, including severe weather, natural disasters, major transport disruption, governmental restrictions, security incidents, strikes, epidemics, civil disturbance, or similar extraordinary circumstances.
Where such circumstances affect a confirmed travel service, the respective rights and obligations of BackTrip and the customer will be determined by the applicable booking conditions and mandatory law.
21. Privacy, Security and Fraud Prevention
We reserve the right to take reasonable measures to prevent fraud, payment abuse, cyberattacks, misuse of promotional offers, false reservations, or other activity capable of harming BackTrip, our customers, or our partners.
Where reasonably necessary, a reservation or transaction may be subject to additional verification.
Any processing of personal data for fraud-prevention or security purposes will be performed in accordance with applicable data-protection law.
22. Changes to the Website and These Terms
BackTrip & Travel may update these Terms of Use from time to time to reflect:
changes to the Website;
new services or functionality;
operational changes;
changes in applicable legislation; or
changes to our business practices.
The most recent version will be published on this page together with the date of the latest update.
Changes will apply from the date on which the updated Terms are published, unless otherwise indicated.
Changes to these Website Terms will not retrospectively alter the contractual terms of an already confirmed reservation except where permitted or required by law.
23. Severability
If any provision of these Terms is found by a competent authority or court to be invalid, unlawful, or unenforceable, the remaining provisions shall continue to apply to the fullest extent permitted by law.
24. No Waiver
If BackTrip does not immediately enforce a provision of these Terms, this does not mean that BackTrip has waived the right to enforce that provision or any other applicable right in the future.
25. Applicable Law and Dispute Resolution
These Terms of Use are governed by French law, subject to any mandatory consumer-protection provisions applicable to the user according to their country of residence.
We encourage customers to contact us first if they experience a problem so that we can attempt to resolve the matter directly.
Consumers may also have access to an independent consumer-mediation procedure in accordance with applicable French consumer law. Details of the consumer mediator appointed by BackTrip & Travel are provided on the Website and/or in our applicable Terms and Conditions of Sale.
Nothing in these Terms deprives consumers of any mandatory right to bring proceedings before a court having jurisdiction under applicable law.
